End User Licence Agreement - EULA

For using our products the following terms of service and end user licence agreement ("EULA") apply between the user and the provider of the products. Using our products and services are only permissible if the user agrees with these terms.
Licenses
The provider grants the user a non-transferable, non-sublicensable, limited right and license to use one copy of the product for personal non-commercial use on a single gaming unit. The rights granted are subject to the user's complicance with this EULA. The product is being licenced to the user but no ownership in the product is being transferred or assigned. This EULA is not to be construed as a sale of any rights in the product.
The term of the user's license under this EULA shall commence on the date that the user accepted this EULA and installed the product and ends on the disposal of the product or our termination of this EULA. The user's licence terminates on any attempt of circumventing any technical protection measures used in connection of the product.
Third Party Services
Our products may include third party services which are subject to the respecting third party terms and conditions. These terms and conditions constitute an agreement between the user and the applicable third party service provider
General Licence Conditions
The user agrees not to:
- comercially exploit our products
- distribute, lease, license, sell, rent, lend, convey, transfer or assign our products or copies thereof, passwords or usernames without the consent of us in this EULA.
- make a copy of our products or any part thereof
- make our products publicly available for use or download by multiple users
- reverse engineer, decompile, disassemble, translate, prepare derivative works based on our products, in whole or in part
- remove, obscure or modify any rights notice, marks or labels contained on or within our products and thereof falsifying or deleting any author attributions, legal notices or other labels of the origin of source of the material
- misrepresent the source of ownership of our products
- create copies of content returned from our products
Our products may allow the user to create content, including videos and screenshots of gameplay. The user grants us to use these contributions in any way and for any purpose.
Our products may require an internet connection to access the interne-based features. Using our products without an internet connection could cause the product to not function in whole or in part.
Collection of Information and Use
We respect the user's privacy rights and recognize the importance of protecting any collected information. Our privacy policy is available at www.byteparrot.com/privacypolicy and is applicable to this EULA. Our privacy policy defines how and why we collect and use information about the user. By installing and/or using our products the user agrees with the terms and conditions of this privacy policy.
Payments and Purchases of Virtual Goods
We may license certain virtual goods to the user to be used within our products for a fee using real money. All virtual goods are licensed to the user on limited, personal, non-transferable, non-sublicensable and revocable basis.
Any payment for licenses for virtual goods is final and non-refundable.
We may manage, regulate, control, modify or delete virtual goods at any time, with or without notice.
The user acknowledges that we are not required to provide a refund for virtual goods for any reason and that the user will not receive money or other compensations for unused virtual goods, whether the loss of license under this EULA was voluntary or not.
Warranty
Our products are provides to the user "as is", with all its faults, without warranty of any kind, without performance assurances or guarantees of any kind. The use of our product is at the user's sole risk. The entire risk of satisfactory quality and performance resides with the user.
Liability Limitations
We won't, ever, be liable for damages resulting from possession, access, use or malfunction of our products, like damages to property, computer failure and to the extent permitted by law, personal damage, lost profits from any action related to this EULA or to our products.
This limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. In no case should our liability for damages exceed the actual price paid by the user for the product causing the damage.
Choice of Law and Jurisdiction
The contract between us and the user will be governed by the laws of Austria without reference to its choice of law rules. Also applying is the mandatory consumer protection of the country of the user's normal residence. The United Nations Convention for the International Sale of Goods shall not apply.
